Background
Simply Sunny Occupational Therapy respects and commits to protecting the privacy of all personal information that is collected by us offline or online, including through our website www.simplysunnyot.com.au. In dealing with personal information, Simply Sunny Occupational Therapy abides by obligations under the Australian Privacy Principles (APP’s) set out in the Privacy Act 1988 (Cth).
The Privacy Act 1988 (Cth) authorises the collection of personal information where this is required to facilitate access to services and to perform other functions required for service provision.
Information Collected and Stored
Simply Sunny Occupational Therapy will collect information which is considered reasonably necessary to carry out our role as a service provider. The kind of information we collect and store includes, but is not limited to, personal information (as defined under the Privacy Act 1988 (Cth)).
We may collect the following types of personal information:
(i) identity information, such as your full name and date of birth;
(ii) contact details, such as your email, address, and phone number;
(iii) government identifiers, such as your participant number under the National Disability Insurance Scheme (NDIS) if applicable;
(iv) relevant NDIS Plan information, reports, and other health information where provided such as diagnoses, medical history and medications;
(v) any other information or documents you provide to Simply Sunny Occupational Therapy;
(vi) information about your interactions with us;
(vii) information you provide via free text inputs such as referral forms;
(viii) your occupation;
(ix) your preferences;
(x) information about you, received by third parties, where you have provided your separate consent to such information, such as information that is or was held by the National Disability Insurance Agency, other health professionals, teachers or educators;
(xi) other personal information that may be required in order to facilitate your dealings with us
Through your interactions with us on our website, we may collect additional information including:
(i) Information you provide to us such as through referral forms or contact us forms;
(ii) automatic data that we receive from your interactions on the Site such as your IP address, activities within the Site, and device ID;
(iii) cookies and similar technologies which are used to track your local computer’s settings for purposes such as logging into your account and your notification settings. These can be turned off in your browser settings.
(iv) third party analytical tools that use cookies to collect information regarding your use of the Site. Third parties may include Google Analytics.
Sensitive Information
Sensitive information is defined under the Privacy Act 1988 (Cth) as “Information or opinion about an individual’s: racial or ethnic origin; political opinions; membership of a political association; religious beliefs or affiliations; philosophical beliefs; membership of a professional or trade association; membership of a trade union; sexual orientation or practices; criminal record; or health information”.
Without your consent, we will not collect sensitive information. Sensitive information will only be collected if it is specifically required for operational purposes. This is subject to certain exceptions such as when collection is required by law, or when the information is necessary for the establishment, exercise or defense of a legal claim.
Purposes of information collection and storage
Where an individual has provided consent, Simply Sunny Occupational Therapy will use and disclose the personal information we collect to provide our services to our clients, family members and other relevant persons.
We will not share any of your personal information with third parties without your consent except:
(i) if we are required by law or we believe in good faith that such action is necessary in order to comply with law, cooperate with law enforcement or other government agencies, or comply with a legal process served on the business (including other service providers or insurers), or court order;
(ii) the disclosure of the information will prevent or lessen a serious and imminent threat to somebody’s life or health;
With the client’s or their responsible person’s consent, we may share your information with third parties such as teachers, other health professionals, the National Disability Insurance Agency, educators, among others. This consent may be withdrawn or amended at request.
We will not share your personal information to a third party for the purpose of direct marketing.
Processes for collecting and storing information
Simply Sunny Occupational Therapy has systems and procedures in place to protect personal information from misuse and loss, as well as from unauthorised access, modification or disclosure. These steps include:
(i) access to personal information is on a need-to-know basis, by authorised personnel;
(ii) storage and data systems are regularly updated and audited
Electronic files are stored on cloud based platforms or within software that are only accessible by authorised personnel. Some of these platforms and software may store data outside in countries including, but not limited to, Australia, US and Canada.
Paper files are stored within key locked cabinets.
Photos or videos will only be taken with consent and will not be held on personal devices.
When no longer required, personal information is either archived or destroyed in accordance with federal law.
Accessing and correcting your personal information
Simply Sunny Occupational Therapy aims to ensure that all personal information held about a person is accurate, up to date, complete and relevant before acting on it. Clients may request to access their personal information held by us or have it amended. If a person learns that the personal information Simply Sunny Occupational Therapy holds about them is inaccurate, outdated, incomplete, irrelevant or misleading, that person can contact Simply Sunny Occupational Therapy so that the information can be updated accordingly.
Where a person requests Simply Sunny Occupational Therapy to correct the personal information we hold about them, we will action this request promptly.
If we do not agree to correct our records as requested, we will give written notice of the decision, setting out our reasons for refusing this request and how the person can lodge a complaint about our decision.
Making a complaint
You may make a complaint about our handling of your personal information, including if you think we have breached the Privacy Act, by contacting Simply Sunny Occupational Therapy in writing by email or mail to the contact information set out at the end of this privacy policy.
Simply Sunny Occupational Therapy will aim to resolve your complaint within 30 days from when your request was made. If we are not able to resolve your complaint, you may wish to contact the Office of the Australian Information Commissioner at the details set out below.
